In a rare legal victory for one of Hong Kong’s most high-profile pro-democracy figures, the Hong Kong Court of Appeal has overturned Jimmy Lai’s fraud conviction and prison sentence, ruling that the case against him did not meet the required legal threshold.
Lai, the founder of the now-defunct pro-democracy newspaper Apple Daily, had previously been sentenced to nearly six years in prison over allegations linked to a lease dispute involving the newspaper’s headquarters. Prosecutors argued that a consultancy connected to Lai had violated lease terms, constituting fraud. However, appellate judges concluded that key elements of the offence had not been sufficiently proven, leading to the conviction being quashed.
The ruling marks an uncommon reversal in a series of legal battles faced by Lai since the introduction of Hong Kong’s sweeping national security legislation in 2020.
